1. Acceptance of Terms
These Terms & Conditions ("Terms") form a binding agreement between you ("Customer", "you") and Arush Labs ("we", "us") governing your use of arushlabs.vercel.app and any Arush Labs product, including Arush Automation (together, the "Services"). By creating an account or using the Services you agree to these Terms.
2. Accounts
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
3. Subscriptions & Payment
Paid plans are billed on the cycle shown at checkout. Fees are exclusive of applicable taxes unless stated otherwise. Non-payment may result in suspension of the Services. See our Refund & Cancellation Policy for details on refunds and cancellations.
4. Acceptable Use
You agree to use the Services in line with our Acceptable Use Policy, applicable law, and WhatsApp/Meta's own commerce and messaging policies. We may suspend accounts that send spam, unsolicited bulk messages, or violate third-party platform policies.
5. Intellectual Property
Arush Labs retains all rights, title and interest in the Services, including our software, branding and documentation. You retain ownership of the content, documents and customer data you upload; you grant us a limited licence to process that data solely to provide the Services to you.
6. AI-Generated Content
Arush Automation uses AI (including the Gemini API) to generate replies, summaries and suggestions. AI outputs may occasionally be inaccurate or incomplete. You are responsible for reviewing AI-generated content before relying on it for business-critical decisions, in line with our AI Usage Policy.
7. Service Availability
We aim for high availability but do not guarantee uninterrupted access. Planned maintenance and incidents will be communicated where practical. See our forthcoming Service Level Agreement for plan-specific uptime commitments.
8. Suspension & Termination
We may suspend or terminate access for breach of these Terms, non-payment, or conduct that risks harm to other users, Arush Labs, or third-party platforms we integrate with (e.g. Meta). You may cancel your subscription at any time from your account settings.
9. Limitation of Liability
To the maximum extent permitted by law, Arush Labs will not be liable for indirect, incidental or consequential damages arising from use of the Services. Our total liability for any claim is limited to the fees you paid us in the 3 months preceding the claim.
10. Disclaimer
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, to the extent permitted by law.
11. Governing Law
These Terms are governed by the laws of India. Disputes will be subject to the exclusive jurisdiction of the courts having jurisdiction over Kanpur, Uttar Pradesh, India.
12. Changes to These Terms
We may revise these Terms from time to time. Continued use of the Services after an update constitutes acceptance of the revised Terms.
